- This agreement (after only "Terms") contains the terms for the use of services provided by PROWEDaward to its Members.
- PROWEDaward is an online community of professional and amateur photographers and is committed to providing a global platform for creative sharing and interaction among users.
- PROWEDaward provides registered members with access to platform features including managing their portfolio, uploading photos, participating in contests, and viewing their galleries. The platform is intended for professional presentation, promotion, and community participation.
- These Terms now form all the conditions governing the use of the Service by registered members and form a legally binding agreement between the Registered Member and PROWEDaward. By clicking REGISTER, the Registered Member agrees to carefully read and understand the terms and conditions set forth in these Terms and agrees to be bound by the same.
§1 Definitions
- Uploaded Content: all photos, text, and other materials that a Registered Member submits to their portfolio, profile, or contests on PROWEDaward.
- Content: all information, images, graphics, data, or other materials made available on the Site, including Uploaded Content from Registered Members.
- Registered Member: a user of 18 years of age or older with full legal capacity who registers an account on the Site in accordance with the prescribed procedure, including Premium and Superior members.
- Service: all products, features, and services provided by PROWEDaward through its website www.prowedaward.com.
- Pages: the websites operated under www.prowedaward.com through which the Service is provided.
- User: any person who accesses or uses the Site or the Service, including visitors, Registered Members, and Premium/Superior members.
- Your Content: any Uploaded Content (photos, text, or other materials) that you post or submit through your Registered Member account.
§2 Availability
- To change, suspend, or discontinue the Service or any part of it.
- To restrict your access to certain features or services, including the complete removal of access to them.
- To refuse to comply with any order or part of it.
- To end your membership and/or delete any content stored on the PROWEDaward website.
- This service is provided by PROWEDaward. PROWEDaward reserves the right to change, suspend, or discontinue the Service at any time and without prior notice. You agree that PROWEDaward is not liable for any unavailability of the Service, including but not limited to interruptions required by maintenance, technical issues, or applicable legal obligations.
§3 Protection of personal data
- We process only the personal data necessary for the operation of this platform, including your name, email address, profile information, uploaded photos, and account settings. These data are used exclusively for providing and maintaining your membership, profile visibility, and participation in the PROWEDaward community.
- Essential cookies are used to ensure core functionality such as language preferences, login sessions, and stable website performance. These cookies do not collect personal data for advertising purposes and cannot be disabled if you wish to use the platform.
- We also use limited technical insights to understand general website performance and stability. These insights do not contain personal information and are not used for advertising or profiling.
- Your uploaded photos, portfolio content, and any descriptive text you publish on your user page remain fully under your ownership. By uploading content, you grant PROWEDaward a non‑exclusive, worldwide license to display, store, resize, and process your content solely for the purposes of operating and promoting the platform.
- You are fully responsible for ensuring that all content you upload complies with copyright laws and that you have the legal right to publish such content. PROWEDaward does not verify copyright ownership and cannot prevent copying of content by third parties using tools outside of our control.
- We reserve the right to remove, hide, or adjust content that violates copyright, contains inappropriate or harmful material, or disrupts the safe operation of the platform.
- PROWEDaward may apply technical limits such as maximum file size, storage capacity, or retention periods to ensure the stable operation of the service.
- If your account becomes inactive for an extended period, we may archive or remove stored content to maintain system performance. We recommend keeping your own backups of all uploaded content, as PROWEDaward cannot guarantee long‑term storage integrity.
- If you decide to cancel and delete your account, please email us at [email protected]. All personal data associated with your account will be permanently deleted in accordance with applicable data‑protection regulations.
§4 Login via Facebook, Google and Apple
storage and processing of data
- If you log in (register) as a visitor via Facebook, Google, or Apple, PROWEDaward only stores and processes the data required to create and maintain your account. For Facebook, this may include your public email address, your name, and your profile picture. For Google and Apple, we only receive your name and email address; no profile picture is provided by these services.
- In your public profile, we display only your name and (when available) your profile picture. Your email address is never shown publicly.
- If you decide to cancel and delete your account, please email us at [email protected] and your personal data will be permanently deleted.
§5 Access and use of the service
- You agree to use the PROWEDaward platform in a lawful, respectful, and responsible manner. All activity on your account must comply with these Terms and applicable laws.
- All trademarks, logos, layouts, design elements, and software of the PROWEDaward platform are owned by PROWEDaward and may not be copied, reproduced, modified, or distributed without prior written consent.
- PROWEDaward does not claim ownership of your photos or text. However, you may not copy, redistribute, or reuse other users’ photos or content without their permission.
- You may not interfere with the technical operation of the Service, including attempting to bypass security measures, disrupt server performance, or gain unauthorized access to any part of the system.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities performed through your account. Notify PROWEDaward immediately if you suspect unauthorized use of your account.
- You may not upload, share, or transmit any content that is illegal, abusive, hateful, harmful, misleading, defamatory, or otherwise inappropriate. This includes, without limitation:
- any content involving minors that violates child‑protection laws,
- any content that infringes copyright or trademark rights,
- any viruses, malware, or harmful code intended to damage or disrupt the Service or its users.
- You may not falsify your identity, misuse account information, or attempt to manipulate the platform’s functionality, ranking system, awards, or contests.
- Commercial use of your own portfolio is permitted (e.g., promoting yourself as a photographer). However, you may not use the Service to sell third‑party products, run unrelated advertisements, or engage in activities unrelated to photography or your portfolio.
- You are solely responsible for any content you upload. PROWEDaward is not responsible for user‑generated content but may remove or restrict access to content that violates these Terms or applicable laws.
- PROWEDaward respects intellectual property rights. If you believe your copyright has been infringed by content uploaded on the platform, please contact us at [email protected] with all required information so we can address the matter promptly.
- The Service may contain links to third‑party websites. PROWEDaward is not responsible for the accuracy, availability, or content of external sites and does not endorse the products or services offered on them. You access such sites at your own risk.
§6 Disclaimer of Warranty and Limitation of Liability
- PROWEDaward does not provide any representations or warranties of any kind, express or implied, regarding the operation of the Service or content or products provided through the Service. You expressly agree that your use of the Service is at your own risk.
- PROWEDaward disclaims all warranties, whether express or implied, including, without limitation, implied warranties that may be invoked, marketability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
- PROWEDaward does not provide any warranty for the security, reliability, timeliness, and performance of this service.
- You specifically acknowledge that PROWEDaward is not responsible for your defamatory, abusive or unlawful behavior or such conduct by third parties. You express all risks and liability for damages and losses resulting from such behavior. You further agree to indemnify PROWEDaward for all damages and losses resulting from such conduct.
- Subject to the express and limited remedies provided herein and to the fullest extent permitted by law, PROWEDaward is not responsible for any damages of any kind arising out of the use of the Service, including but not limited to direct, indirect, incidental, consequential, extraordinary, exemplary or repressive damage, even if PROWEDaward has been advised of the possibility of such damages.
- Previous disclaimers of liability, exceptions and limitations apply regardless of any failure of the primary purpose of any limited remedy.* in no event shall PROWEDaward's aggregate liability to you exceed the amounts paid by you, if any, to PROWEDaward pursuant to this agreement.

- The failure of PROWEDaward to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be fully valid and enforceable.
- PROWEDaward may assign its rights or delegate its obligations under these Terms to another entity as part of business operations or restructuring. You may not transfer your rights or obligations without our prior written consent.
- These Terms are governed by the laws of Slovakia and applicable European Union regulations.
- You agree to make reasonable efforts to resolve any dispute with PROWEDaward amicably. If a dispute cannot be resolved within 30 days, it shall be settled by the competent courts of Slovakia.

- The photos displayed on PROWEDaward are not owned by us. Photographers voluntarily upload their photos and maintain full ownership rights. Prior to utilizing any uploaded photos from PROWEDaward, we kindly urge you to seek direct permission from the respective owner. This ensures that the use of these photos aligns with copyright regulations and agreements with the owners.
- Members who upload photos to PROWEDaward bear full responsibility for complying with copyright laws. In the event of any copyright infringement, members who uploaded those specific photos are entirely accountable. If you discover any of your photos uploaded to PROWEDaward without authorization, and you hold the rights to those photos, please reach out to us at [email protected]. Your report will enable us to address the situation and respect copyright ownership.
- By uploading content, you grant PROWEDaward a non‑exclusive, worldwide license to display, store, resize, and process your photos and text solely for the purposes of operating and promoting the PROWEDaward platform. This license does not transfer ownership; you remain the full copyright holder.
